The best-known examples of such declarations are those of the UN General Assembly in the human rights field, starting with the Universal Declaration of Human Rights (A/RES/217A[III]) and followed by others relating to racial and gender discrimination, torture, the rights of children, etc.; in other areas one might mention the declarations on outer space and on the seabed - all of which were later followed by detailed conventions. In the environmental field there are fewer examples, of which the most important is the 1972 Stockholm Declaration; one might, however, also mention the General Assembly's first resolution on "Protection of Global Climate for Present and Future Generations of Mankind' (A/RES/43/53 of 6 Dec. 1988), which, though not designated as a solemn declaration, did contain both substantive recommendations and procedural arrangements for starting the treaty-making process.
4. Both the 1972 Stockholm Declaration and the 1982 World Charter for Nature took several years to develop in specialized organs, respectively the Preparatory Commission for the United Nations Conference on the Human Environment and the Ad Hoc Group of Experts on the draft World Charter for Nature.
5. Within the UN system, it is clear that UNEP has become the predominant sponsor of international environmental treaties, both on a worldwide and on regional and local levels (e.g., in connection with its Regional Seas Programme). It is therefore interesting to note that nothing in its charter (A/RES/2997[XXVlI] of 15 Dec. 1972) specifically authorizes it, or its Governing Council or its Environment Secretariat, to undertake that function. Nevertheless, the only time when the General Assembly has interfered with UNEP's initiation of work on a multilateral treaty negotiation was in connection with the proposed agreement for protecting the global climate, for which the Assembly established the ad hoc Intergovernmental Negotiating Committee for a Framework Convention on Climate Change (A/RES/45/209 of 21 Dec. 1990) after UNEP and WMO had in effect initiated the process through their joint Intergovernmental Panel on Climate Change (IPCC).

Although every negotiation has its own dynamics, it is not unusual for the most important issues to remain open until the bitter end (and sometimes a little bit past it) as many participants are unwilling to make their final concessions (or to squeeze from their governments the authorization for still further ones) until faced with the prospect that they or their governments may be blamed for the collapse of a long-lasting high-profile negotiation.
20. For example, the Kuwait Regional Conference of Plenipotentiaries on the Protection and Development of the Marine Environment and the Coastal Areas (Kuwait, 15-23 Aug. 1978) adopted: (i) a Final Act of the Conference; (ii) an Action Plan; (iii) the Kuwait Regional Convention for Co-operation on the Protection of the Marine Environment from Pollution; (iv) the Protocol concerning Regional Co-operation in Combating Pollution by Oil and Other Harmful Substances in Cases of Emergency; and (v) five Resolutions on matters such as the Interim Secretariat, Financial Arrangements. Establishment of the Marine Emergency Mutual Aid Centre, etc.
21. It is often said that decisions reached by extensive negotiations, such as are usually required in order to reach consensus, represent the "lowest common denominator" (LCD) of the views of the participants. This terminology is mathematically incorrect, for the LCD of any set of numbers is one. In any negotiation one strives to reach the "highest common denominator" (HCD), but that HCD may he very low if the parties are many and their positions far apart.
22. The first important negotiation for which such a procedure was formalized was the Third UN Conference on the Law of the Sea - see the very elaborate Rule 37 of the Rules of Procedure of the Conference (A/CONF.62/30 or the several revisions thereof). For much simpler, more recent versions of such a rule, see Article 9(3) of the Vienna Ozone Convention and Article 10(9) of its Montreal Protocol as amended in 1990 in London.
23. Though formal "weighted voting" is anathema in most of the UN system IGOs and treaties (except of course for the Bretton Woods institutions). it cannot be entirely eliminated. Thus, for example, Article 16 of the Montreal Ozone Protocol provides that for entry into force at least 11 ratifications are required, but these must include those of states (or regional economic integration organizations) "representing at least two-thirds of 1986 estimated global consumption of the controlled substances." This means that states whose collective consumption equals just over a third of that of the world as a whole (i.e. just two or three) can block entry into force, regardless of how many other states are prepared to enter into the Protocol.
24. One such treaty, with important environmental provisions, is the 1982 UN Convention on the Law of the Sea, 21 I.L.M. 1261 (1982). which in spite of 161 signatures has now been waiting nearly 10 years for the necessary ratifications.

A much more common-sensical approach was used in respect of the 1987 Montreal Protocol, see supra note 23, though it left the depositary (the UN Secretary-General) with the technical difficulty of determining when the specified condition had been fulfilled.

There are, however, some instances in which no arrangement was made for States Parties to exclude themselves from the effect of certain dispositions made by an IGO organ pursuant to a provision of a treaty. No. 17512, 16 I.L.M. 1391 (1977); Principles 2, 5, 6, and 7 of the Stockholm Declaration and paragraphs 5 and 20 of the World Charter for Nature; although it appeared that Iraq was not a party to the two treaties and of course could assert that the Declaration and Charter were merely hortatory, the Chairman of a Canadian/UN Conference of Experts on the Use of the Environment as a Tool of Conventional Warfare (Ottawa, 10-12 July 1991) concluded (in a not uncontroverted statement) at the end of the session that ``the customary laws of war, in reflecting the dictates of public conscience, now include a requirement to avoid unnecessary damage to the environment."

In essence, sustainable development is a process of change in which the exploitation of resources, the direction of investments, the orientation of technological development, and institutional change are all in harmony and enhance both current and future potential to meet human needs and aspirations.1
This chapter addresses the evolving role of information in a regime to deal with international environmental issues that must now be adjusted to reduce global risk and achieve sustainable development. The goal set by governments at the 1972 UN Conference on Human Environment was not merely to be better informed about changing environmental conditions but also to "protect and enhance the quality of the human environment for present and future generations."2
Thus, information is sought both for better understanding of environmental conditions and trends and to serve as a basis for planning and managing human activities to protect and enhance environmental conditions. In the framework governments approved for the 1972 Stockholm Action Plan these were identified as "assessment" and "management" functions.
Parallel with great technical and social advances in recent years that improve access and free exchange of environmental information, there have been several developments that pose new difficulties in promoting the free flow of pertinent information at the international level:
1. As the 1972 environmental agenda has broadened the initial focus on pollution has given way to international concern about natural resources and, now, poverty, population, and a host of environment-and-development issues; all these touch more directly on domestic matters than does pollution.
2. Improved assessment results since 1972 have highlighted the need to take action to counter deterioration, to slow accumulation of pollutant levels and high rates of loss of soils, forests, etc., i.e., to move from "assessment" to "management" actions, some of which carry economic and other difficult implications.
3. "Global change" is now recognized as driven by local action or lack of it, and therefore the place where corrective steps are needed is closer to home than far away places like Antarctica and the high seas.
Conditions favouring "transparency," "glasnost," and public access to information have greatly improved since 1972, both nationally and internationally, and the end of the Cold War removes social constraints from broad application of new technologies that can improve availability of information useful for reducing global risk and putting development on a sustainable basis. However, the kinds of information sought for the goals to be set in 1992 will be challenging, especially since the parallel issues of environment and development are now formally joined for the first time, and we are forced to recognize links between local development action and global environmental change; even national or local actions taken in the name of "development" - to improve the quality of life for present generations or to satisfy consumption demands of the affluent3 - can pose risks of global as well as local impacts.
As always, the future will not be like the past. And now, as the Brundtland Commission alerts us, the rate and scale of global change is itself changing:
Our human world must make room in a finite environment for another human world. The population could stabilize at between 8 billion and 14 billion sometime next century.... More than 90 percent of the increase will occur in the poorest countries, and 90 percent of that growth in already bursting cities. Economic activity has multiplied to create a $13 trillion world economy, and this could grow five- or tenfold in the coming half-century. Industrial production has grown more than fiftyfold over the past century, four-fifths of this growth since 1950. Such figures reflect and presage profound impacts upon the biosphere, as the world invests in houses, transport, farms, and industries. Much of the economic growth pulls raw material from forests, soils, seas, and waterways.4
As attention turns to the new agenda at the 1992 UN Conference on Environment and Development in Rio, a major challenge will be to take advantage of new openness and freedom of access to information under conditions of transparency and glasnost in ways that encourage international cooperation and avoid stimulating resistance by those who feel at a disadvantage. New requirements for information to understand and reduce global risk, while putting economic and social development on a sustainable basis, may appear threateningly intrusive to information-poor states, especially when outsiders are better informed than domestic officials and experts. This suggests the desirability of a major international effort to strengthen human and institutional capabilities in relation to gathering and analysing information for domestic as well as international use so that all states can participate on a more equal basis without feeling threatened by freely available information about subjects they consider sensitive in terms of national interests.
In any case, since sound information is a necessary basis for negotiation, it follows that information competence must be strengthened internationally if wide participation is sought for international agreements to cope with global change.5
This chapter outlines changing information requirements since 1972, some of which evolved out of improved understanding and assessments launched at the Stockholm Conference, which, in turn, laid the basis for the new environment-and-development agenda and the goals of "sustainable development" and coping with "global change." Principles have been proposed that could guide future work in this area, but, as a practical matter, and given the nature of information that will be needed, it will probably be necessary first to use existing mechanisms to improve human and institutional skills in the field of information.
Changing environmental information requirements
The kinds of information needed to support the 1972 goal have been identified and considerable progress made since then on cooperative programmes to produce credible information about environmental conditions and trends, assessments of their significance for present and future generations, and ways to present it in forms that can influence planning and decision-making.
The most successful example concerns pollutants whose global significance has been highlighted by research and monitoring programmes initiated in 1972 to cope with risks to stratospheric ozone that were then seen in terms of high-flying, second-generation supersonic aircraft.6 A study of such "outer limits" as the ozone content of the stratosphere was proposed in 1973 by UNEP's first Executive Director, Maurice Strong, and as speculation developed over the possible role of CFCs, UNEP and a number of specialized agencies (including WMO, WHO, FAO, Unesco) and others (like ICSU and the International Chamber of Commerce) drew up a "World Plan of Action on the Ozone Layer" that was approved by governments in 1977. Cooperative investigations under this plan led to the discovery of the Antarctic Hole phenomenon and negotiation of the 1985 Vienna Convention and the 1987 Montreal Protocol; continuing information flows support its ongoing revision.
Although CO2 was recognized over 100 years ago as a potential greenhouse gas, comparable levels of understanding have not yet been achieved with regard to climate change, but negotiations on a possible convention are under way as part of the preparations for UNCED.
Pollutants of international significance at the regional scale have also been investigated under cooperative programmes initiated since Stockholm, such as "acid rain," for which region-wide monitoring programmes in Europe led to the 1979 Long-Range Transboundary Air Pollution Convention and subsequent protocols.
Many pollutants, such as those commonly found in the workplace or in urban concentrations, have purely local effects and are therefore not often dealt with by international agreements but nonetheless benefit from international cooperation because many countries share similar problems. Considerable progress has been made in improving knowledge and making it available in forms that aid those trying to cope with these problems at the national and local levels.
But whereas concern over pollutants dominated the environmental agenda at Stockholm, since then attention has turned increasingly to natural-resource problems such as desertification, deforestation, and the loss of biological diversity. These problems often result from deliberate domestic practices to exploit natural resources that are clearly within national jurisdiction, and since the practices are directly relevant to national development goals and their external effects are less visible than in the case of pollutants, there are more obstacles to the free flow of information about them than about pollutants, whether the information is needed for assessment or for management purposes.
International cooperation to produce and exchange scientific information for the purpose of better understanding started long before the Stockholm Conference and in many important ways shaped what followed in the UN Environment Programme (UNEP). This experience will undoubtedly be taken into account when, 20 years later, far more difficult issues are tackled at the 1992 "Earth Summit" in Rio. What started out as a 20-year review of progress since the Stockholm Conference has been given a more demanding task by the UN General Assembly; namely, to "elaborate strategies and measures to halt and reverse the effects of environmental degradation in the context of strengthened national and international efforts to promote sustainable and environmentally sound development in all countries."7
